Terms of Use

1. Who we are

Capten (“Capten”, “Service”, “we”, “us”) is a web application for AI-assisted video captioning, editing, brand kits, export, and related features (including WhatsApp captioning on eligible plans). The Service is operated by OnnOff Studio.

2. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your place of residence) to use Capten. If you use Capten on behalf of an organisation, you represent that you have authority to bind that organisation.

You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly at support@capten.cc if you suspect unauthorised access.

• Provide accurate registration information
• Do not share accounts unless your plan expressly allows team access
• Do not attempt to bypass plan limits, rate limits, or security controls

3. The Service

Capten provides tools to upload or otherwise submit video/audio, generate draft captions (including Hinglish and other Indian languages), edit timing and style, manage brand kits and workspaces (where available), and export burned-in captioned media. Features depend on your plan and may change as we improve the product.

AI output is probabilistic. Transcription, timing, and styling suggestions may contain errors. You are solely responsible for reviewing captions before publishing or distributing any exported file.

4. Your content & licence

You retain ownership of videos, audio, captions, brand kits, and other materials you submit (“User Content”). You grant OnnOff Studio a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and display User Content solely to operate and improve the Service (including transcription, rendering, storage, and support).

You represent that you have all rights needed to submit User Content and that it does not infringe others’ rights or violate law.

• Do not upload illegal, harmful, or infringing material
• Do not upload content you do not have permission to process
• Client / workspace features do not transfer ownership of client assets to Capten

5. AI, third parties & WhatsApp

Caption generation may use third-party speech and infrastructure providers (for example cloud GPU, speech APIs, or messaging platforms). Your use of those integrations is subject to their terms where applicable.

WhatsApp captioning (where enabled) requires you to comply with Meta’s WhatsApp Business / messaging policies. You are responsible for the videos you send and for obtaining any consents required from end users who message your Capten number.

6. Plans, billing & taxes

Paid plans are billed in INR as shown on the Pricing page, plus applicable taxes (including GST where required). Launch or promotional pricing may apply for a limited time; continuing subscribers may keep locked rates as described at purchase.

Usage quotas (videos, WhatsApp jobs, brand kits, seats, etc.) reset or renew according to your plan. Failed jobs may be excluded from quotas at our reasonable discretion; re-exports after edits may count as additional usage.

Payment processors handle card/UPI data; Capten does not store full payment card numbers.

7. Acceptable use

You agree not to misuse Capten. Prohibited conduct includes, without limitation:

• Violating any law or third-party right
• Uploading malware, scraping the Service abusively, or attacking infrastructure
• Reverse engineering except where permitted by mandatory law
• Using Capten to generate or distribute CSAM, non-consensual intimate imagery, or content that facilitates serious harm
• Reselling the Service or automating access in a way that circumvents plan limits without written permission

We may suspend or terminate accounts that violate this section.

8. Our intellectual property

The Capten name, logos, UI, software, presets (including looks such as Instrument Phrase), and documentation are owned by OnnOff Studio or its licensors. Except for the limited right to use the Service under your plan, no rights are granted to you.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF AI OUTPUT, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OnnOff Studio AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Suspension & termination

You may stop using Capten at any time and cancel paid plans as described in the Refund & Cancellation Policy. We may suspend or terminate access for violations of these Terms, non-payment, risk to the Service, or legal requirements. Upon termination, your right to use the Service ends; we may delete User Content after a reasonable retention period unless law requires otherwise.

12. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in India shall have exclusive jurisdiction, subject to any mandatory consumer protections that apply to you.

13. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes become effective constitutes acceptance, except where mandatory law requires additional consent.
